Terms of Service
Effective date: 28 September 2026 — Last updated 1 September 2026
1. Who We Are and What These Terms Cover
These Terms of Service ("Terms") govern your access to and use of the website www.wildandwonder.co.nz (the "Website") and your purchase of products from Wild & Wonder 2026 Limited trading as Wild and Wonder ("Wild and Wonder", "we", "us", or "our"), a company registered in New Zealand under (company number
9439823), with its registered office at 628 Horseshoe Bush Road, Waitoki.
We design and sell magnetic wall decals and children's furniture ("Products"). By browsing the Website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or purchase our Products.
These Terms should be read together with our Shipping Policy, Returns and Refunds Policy, and Privacy Policy, each of which is incorporated into these Terms by reference.
2. Eligibility and Use of the Website
You must be at least 18 years old, or purchasing under the supervision and with consent of a parent or guardian, to place an order on the Website. The Website and our Products are intended for use by adults purchasing on behalf of children; the Website itself is not directed at children and we do not knowingly collect personal information directly from children (see our Privacy Policy).
You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Website. You must not attempt to gain unauthorised access to the Website, our systems, or any account that is not your own.
3. Products, Descriptions and Availability
We make every reasonable effort to display our Products, including colours, dimensions, materials, and piece counts, as accurately as possible. However, colours may vary slightly depending on your device's display, and minor variations in dimensions or materials may occur as part of the natural manufacturing process. Product images are illustrative and may include props, accessories, or scale references that are not included with the Product.
All Products are subject to availability. We reserve the right to limit quantities, discontinue a Product, or refuse an order at our discretion, including where a Product has been mispriced or incorrectly described due to a technical or human error, in which case we will notify you and offer a full refund of any amount paid.
4. Product Safety: Magnets and Small Parts
CHOKING AND INGESTION HAZARD. Wild and Wonder Products contain magnets and/or small parts. If a magnet is swallowed or inhaled, it can attract to another magnet or metal object through the walls of the intestine or other body tissue, causing serious internal injury, infection, or death, and may require emergency surgery. Seek immediate medical attention (including an X-ray) if you suspect a child or anyone else has swallowed or inhaled a magnet or small part, even if they appear well, as symptoms are often mistaken for a common stomach illness. Keep loose or damaged magnetic pieces away from children of any age, and away from anyone with pacemakers or other medical implants.
Each Product listing on the Website includes the manufacturer's recommended age grading and relevant warnings (for example, choking hazard warnings for small parts, and warnings for products not suitable for children under 3 years, or under 8 years where high-powered magnets are involved). You must read and comply with all warnings and age recommendations printed on the Product packaging and displayed on the Website before allowing a child to use a Product, and must supervise young children during play.
We take reasonable steps to ensure our Products comply with the applicable New Zealand toy safety standard (AS/NZS ISO 8124) and are not "unsafe goods" for the purposes of the Fair Trading Act 1986, including the Unsafe Goods (Small High Powered Magnets) Indefinite Prohibition Notice 2014, which restricts the sale of certain separable, loose high-powered magnets. If you have any concern about the safety of a Product you have received, including a damaged item, a missing part, or a magnet that has become dislodged from its housing, stop use immediately, keep it away from children, and contact us at hello@wildandwonder.co.nz.
5. Pricing and Payment
All prices on the Website are displayed in New Zealand dollars (NZD) and are inclusive of Goods and Services Tax (GST) where applicable, unless otherwise stated. Prices do not include shipping costs, which are calculated and displayed at checkout in accordance with our Shipping Policy.
We reserve the right to change prices listed on the Website at any time. Any price change applies only prospectively and will not affect the price of a Product you have already ordered and had confirmed under clause 6. Payment must be made in full at the time of order using one of the payment methods offered at checkout (credit/debit card, Afterpay). All payments are processed securely by our third-party payment providers; we do not store your full card details on our systems.
6. Order Acceptance and Cancellation
Your order is an offer to purchase, which we may accept or decline. A contract is formed only when we send you an order confirmation email. We may cancel or decline an order (in whole or in part) at any time before dispatch, including where a Product is out of stock, where we suspect fraud, or where a pricing or listing error has occurred, and we will refund any amount you have paid for the cancelled part of the order.
You may request to amend or cancel an order after it has been placed by contacting us at hello@wildandwonder.co.nz as soon as possible. We will try to accommodate your request, but we cannot guarantee changes or cancellation once an order has been packed or dispatched.
7. Intellectual Property
All content on the Website, including text, graphics, logos, product designs, photographs, and the Wild and Wonder name and branding, is owned by or licensed to us and is protected by New Zealand and international intellectual property laws. You may view, download, and print material from the Website for your own personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works from any part of the Website or our Products without our prior written consent.
8. Your Use of the Website and Products, and Indemnity
You agree to indemnify Wild and Wonder against any claim, loss, or reasonable cost we incur arising from:
- your breach of these Terms;
- your misuse of the Website;
- your infringement of a third party's rights through your use of the Website; or
· a Product being used other than as intended, modified, damaged, or having its components (including magnets) removed or tampered with after purchase, or a failure to follow the age recommendations, safety warnings, or assembly and anchoring instructions provided with a Product.
This indemnity does not apply to the extent a claim, loss, or cost arises from our own negligence or breach of these Terms.
9. Your Rights Under Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy that you have, or any guarantee, warranty, or condition implied or imposed by the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand legislation, where it would be unlawful to do so. Where you acquire Products for the purposes of a business (as defined in the Consumer Guarantees Act 1993), you agree that the guarantees in that Act do not apply, to the extent permitted by law.
For details of your rights and remedies if a Product is faulty, not as described, or otherwise fails to meet the guarantees under the Consumer Guarantees Act 1993, please see our Returns and Refunds Policy.
To the maximum extent permitted by law, and without limiting clause 9 above, the Website and Products are provided "as is" and we make no representation or warranty, express or implied, as to their quality, merchantability, or fitness for a particular purpose.
10. Product Recalls
If a Product is recalled or withdrawn from sale by us or by a regulator, or becomes subject to a safety notice, we will notify affected customers using the contact details provided with their order and will offer an appropriate remedy, such as a refund, repair, or replacement, in accordance with the Fair Trading Act 1986.
11. Limitation of Liability
To the maximum extent permitted by law, and subject to Clause 9 above, our total liability to you arising out of or in connection with these Terms or your use of the Website or Products, whether in contract, tort (including negligence), or otherwise, is limited to the amount you paid for the relevant Product. We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits or data, arising out of or in connection with your use of the Website or Products.
Where the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other enactment implies a guarantee, condition, or warranty in your favour that cannot lawfully be excluded, that guarantee, condition, or warranty applies in full. Where it can lawfully be limited, our liability under it is limited to the minimum extent the relevant enactment allows.
We are not responsible for injury, loss, or damage arising from a failure to follow the age recommendations, safety warnings, or assembly instructions provided with a Product, from a Product being used other than as intended, or from a Product being modified, damaged, or having its components (including magnets) removed or tampered with after purchase.
We do not warrant that the Website will be uninterrupted, error-free, or secure, or that it is free of viruses or other harmful components, and we are not liable for any loss or damage arising from unauthorised access to, or interference with, the Website or your account by any third party, except to the extent such liability cannot lawfully be excluded.
Payments made using Afterpay or another third-party payment provider are also subject to that provider's own terms and conditions. We are not liable for any act, omission, error, or delay of a third-party payment provider.
12. Furniture-Specific Terms
Furniture Products may require self-assembly. Assembly instructions and any relevant weight limits, wall-anchoring requirements (for example, for tall or freestanding furniture such as bookcases and drawer units), and care instructions are provided with the Product and on the relevant Product page. Failure to correctly assemble, anchor, or maintain furniture Products in accordance with the instructions provided may create a tip-over or other safety hazard, particularly around young children, and we recommend anchoring freestanding furniture to a wall stud using the hardware provided. To the maximum extent permitted by law, Wild and Wonder is not liable for any injury, loss, or damage arising from a failure to assemble, anchor, or maintain a furniture Product in accordance with the instructions and warnings provided, except to the extent such liability cannot lawfully be excluded.
13. Force Majeure
We are not liable for any delay or failure to perform our obligations under these Terms where the delay or failure results from circumstances beyond our reasonable control, including natural disasters, extreme weather, courier or supply chain disruption, industrial action, or government restrictions.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, our Products, or the law. The current version will always be available on the Website, along with the date it was last updated. Changes will not apply retrospectively to orders placed before the update.
15. Governing Law and Disputes
These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the courts of New Zealand. If you have a complaint, please contact us first at hello@wildandwonder.co.nz so we can try to resolve it directly. If we are unable to resolve a dispute about a Product of which the quantum of claim is under the applicable threshold, you may be able to apply to the New Zealand Disputes Tribunal.
16. Representations
No statement, description, or representation made by any of our staff, agents, or representatives is binding on us, or forms part of these Terms, unless it is confirmed by us in writing. This clause does not affect the accuracy of Product descriptions published on the Website (see Clause 3), or any right or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, which are not affected by this clause.
17. Assignment
We may transfer or assign our rights and obligations under these Terms, including as part of a sale, merger, or reorganisation of our business, without your consent, provided this does not reduce your rights under the Consumer Guarantees Act 1993 or these Terms. You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
18. Subcontracting
We may engage subcontractors or third-party providers, including couriers, payment processors, and warehousing or fulfilment providers, to perform any part of our obligations to you.
19. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. These Terms, together with our Shipping Policy, Returns and Refunds Policy, and Privacy Policy, constitute the entire agreement between you and Wild and Wonder in relation to your use of the Website and purchase of Products.
